This Privacy Policy is designed to help you understand how Ahora LLC (“Ahora,” “we,” “our,” or “us”) collects and uses the information that you provide to us when you use the website located at www.pheno.org (the “Website”), or any other content, features, or applications that we may offer from time to time in connection with our business (collectively, the “Services”).
By accessing or using the Website or the Services, you are accepting the practices described in this Privacy Policy.
1. Type of Information We Collect
a. Profile Information Submitted by Members
When you register as a member with Ahora (a “Member”) through the Website or the Services, you voluntarily provide us with certain personal information, such as your name, email address, telephone number, mailing address, gender, and any other personal or preference information that you provide to us.
b. Other Information Submitted by Members
Members may submit other information to Ahora when setting up a personal profile, sending messages, performing searches, or interacting with other Users (as defined below) through discussion forums, message boards, chat rooms, blogs, or any other Services.
c. Use Information Not Directly Submitted by Users
i. When you enter the Website, wheather you are a Member or are simply browsing the Website (a “Visitor”), we collect your browser type and IP (Internet Protocol) address. This information is gathered from all Users (as used herein, the term “User” refers to a Member or a Visitor). In addition, we store certain information from your browser using “cookies.” A cookie is a piece of data stored on a User’s computer tied to information about the User. We use session ID cookies to confirm that Users are logged in. These cookies terminate once the User closes the browser. By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you use the Services. You can remove or block this cookie using the settings in your browser if you want to disable this convenience feature.
ii. We may also collect information about you from other sources, such as newspapers, blogs, instant messaging services, and other users of the Services through the operation of the service (e.g., photo tags) in order to provide you with more useful information and a more personalized experience.
iii. We collect this information so that we can provide you the service and offer personalized features. In most cases, we retain this information so that, for instance, you can return to view prior messages you have sent or easily see your list of contacts. When you update information, we usually keep a backup copy of the prior version for a reasonable period of time to enable reversion to the prior version of such information.
2. Use of Information Obtained by Ahora
a. When you register with Ahora, you create your own profile and privacy settings. Your profile information, as well as your name, email and photo, are displayed to people in the groups specified in your privacy settings to enable you to connect with people on or through the Services.
b. We use profile information primarily to be presented back to and edited by you when you access the Services, and to be presented to other Users permitted to view such information as is allowed by your privacy settings.
c. We also use tracking information such as cookies to create aggregate reports on user demographics and Website traffic patterns. This tracking information is provided to our advertisers and partners enabling them to better target their advertisements to our Users. We also use IP addresses to analyze trends, administer the Website, track a User’s movement, and gather broad demographic information for aggregate use.
d. Profile information you submit to us may be available in search results across the Ahora network to enable Users to connect with Members. Your name and profile picture thumbnail may be available in these search results, and those limited pieces of information may be made available to third-party search engines. People who see your name in searches, however, will not be able to access your profile information unless they have a relationship to you (friend, friend of friend, member of your networks, etc.) that allows such access based on your privacy settings.
e. You post Content (as defined in our Terms of Use) on or through the Services at your own risk. Although we may allow you to set privacy options that limit access to your pages, please be aware that no security measures are perfect or impenetrable. We can not control the actions of other Users with whom you may choose to share your pages and information. Therefore, we can not and do not guarantee that any Content you post on or through the Services will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or through the Services. You understand and acknowledge that, even after removal, copies of any Content you post may remain viewable in cached and archived pages or if other Users have copied or stored your Content.
f. If you choose to use our invitation feature to tell a friend about the Website or the Services, or our mail to a friend feature to share an interesting topic with a friend, we will ask you for your friend’s email address so that we may send an invitation. We will automatically send your friend a one-time email inviting him or her to visit the Website. We store this information to send the invitation, and to track the success of our referral program. Any person who receives an invitation may contact us to request the removal of this information from our database.
3. Display of Members’ Information
Except where a Member might choose to include a full name in his or her profile, a Member’s email address and full name will only be used in the following circumstances:
· When the Member invites a friend via email to become a Member.
· When the Member sends a request to another Member to add the other Member to his or her friend list.
· When we send service-related notification or announcement to the Member relating to his or her use of Service.
· If the Member so chooses, when we send regular notifications, weekly updates, or other news regarding the Services.
4. Sharing Your Information with Third-Parties
a. Except as set forth in this Privacy Policy, we do not rent, sell, trade, give away, or share personal information about you with other people or non-affiliated companies except to provide products or services you have requested, when we have your permission, or under the following circumstances: (i) to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims; and (ii) when we believe it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.
b. We may share profile information and aggregate usage information in a non-personally identifiable manner with advertisers and other third-parties in order to present to Users more targeted advertising, products and services; provided however, that in such situations, we will never disclose information that would personally identify you. As set forth above, we may (i) use your email address to conduct market research for our internal use only; and/or (ii) use your email address to market the Services to you (e.g., new features and applications, announcements, opportunities of interest). We may contract with a third-party to conduct such research and marketing; provided however, that such third-party will be fully bound by an obligation of confidentiality to us and may not use any personally-identifiable information provided by us other than as expressly instructed by us and in strict compliance with the terms of this Privacy Policy.
c. When you use the Services, certain Content or information you post or share with third-parties (e.g., a friend), such as personal information, comments, messages, photos, videos, or other information, may be shared with other Users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos, or other items, this information may become publicly available.
5. Links
The Website may contain links to other websites. We are not responsible for the privacy practices of any other website, including any third-party website’s use of cookies or any other information collected when you click-through to such websites or view advertisements served by them. Even though certain information collected by such third-party websites might not identify you personally, we strongly encourage you to become familiar with their privacy practices, and to contact such the proprietor’s of such websites if you have any questions about their respective privacy policies. This Privacy Policy applies solely to information we collect through the Services.
6. Third-Party Advertising
a. Advertisements that appear on the Website are sometimes delivered directly to Users by third-party advertisers. These advertisers may use cookies in order to recognize your computer each time they send you an advertisement. Doing this allows the advertising network to measure the effectiveness of their ads and to personalize advertising content. In this way, the advertisers may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. We do not have access to or control of the cookies that may be placed on the computer of any User by the third-party advertisers. Third-party advertisers have no access to your contact information stored on the Website unless you choose to share it with them.
b. This Privacy Policy covers the use of cookies by Ahora and does not cover the use of cookies or other tracking technologies by any of its advertisers.
7. Security
The Ahora account of every Member is password-protected. We take appropriate precautions to protect a Member’s information. We use industry standard measures to protect all information that is stored on our servers and within our database. Because email and instant messaging are not recognized as secure communications, we request that you not send private information to us by email or instant messaging services. If you have any questions about the security of the Website, please contact us.
8. Changing or Removing Information
If your profile information changes, or if you no longer desire to be a Member, you may correct, update or remove the personal data that you provided. This can be done on your profile settings page. Residual information may persist in backup copies for a reasonable period of time but will not be generally available to other Users.
9. Terms of Use, Notices and Revisions
Your use of the Services, as well as any dispute arising from such use, is subject to this Privacy Policy and our Terms of Use, including the dispute resolution provisions contained therein. We reserve the right to change our Privacy Policy and our Terms of Use at any time. Clarifications and non-material changes to this Privacy Policy will take effect immediately, and material changes will take effect within 30 days after such changes are posted on the Website. If we make changes, we will post and indicate the effective date of the revised policy. If we are going to use a User’s personally identifiable information in a manner different from that stated at the time of collection, we will notify those Users via email or by placing a prominent notice on our website. We encourage you to refer to this policy on an ongoing basis so that you understand our current Privacy Policy. Unless stated otherwise, our current Privacy Policy applies to all information that we have about you and your account.
10. Children Under Age 13
a. Ahora does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13 years of age, please do not attempt to register for the Services, or to send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to us, or on the Website or through the Services. In the event that we learn that we have collected personal information from a person under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from or about a person under age 13, please contact us.
b. Any improper collection or misuse of information provided on or through the Services is a violation of our Terms of Use. Please contact us to report such violations.
11. Special Provision Applicable to Users Outside of the United States
By using the Services, you are consenting to have your personal data transferred to and processed in the United States.
